20 O V E R A C E N T U R Y : B U I L D I N G B E T T E R B A N K S - H E L P I N G C O L O R A D A N S R E A L I Z E D R E A M S T he Colorado Bankers Association this session ushered two pieces of legislation aimed at protecting the val- ue of a state charter, as well as banks’ ability to use credit information when making employment decisions. A 2013 lawwhich limited employers’ use of credit information in employment decisions – but exempted banks from the law – was interpreted by the state as prohibiting all businesses, in- cluding banks, fromusing the information after it was accessed. In response, CBA pursued legislation in the 2014 session, SB14-102, to solidify the intent of the 2013 bill and reiterate banks’ ability to access and use the information. The bill, which was signed into law by Governor John Hick- enlooper in March. A second proposal, aimed at protecting the value of a state charter, was also signed into law by Governor Hickenlooper recently. Until unanimous passage of HB14-1274, Colorado lawprohib- ited a state bank from executing a contract for the employment of an officer of more than one year, and required 2/3 of a state bank’s directors to be Colorado residents. Lastly, law required bank directors to live within 100 miles of the bank’s place of business. HB14-1274 repealed the limitations, replacing it with only requiring a majority of directors to live in the state, using lan- guage CBA drafted. New CBA leadership nominated In a unanimous vote mid-April, CBA’s board of directors voted to nominate the following bankers to lead the organization in the 2014-2015 year. Nominees are voted upon by the organi- zation as a whole during its annual summit in May. They are: Jeff Schmitz is the Executive Vice President and Chief Operating Officer of Citywide Banks. Jeff has been employed at the bank since 1997 and has been on its board of directors for over 14 years. His direct responsibilities include the oversight of deposit operations, IT, marketing, CRA, residential mortgage, and human resources. Before Citywide he spent several years in the real estate sales and financing industries in the Denver Metro market. In 1994, Mr. Schmitz co-founded JamLOGIC Software, which designed human re- sources tools for small companies around the country and was sold to a strategic partner in 2000. He earned a bachelor’s degree in Finance from Gonzaga University. Mr. Schmitz is a Board Member of Colorado Bankers Association, Colorado Uplift and Archdiocese of Northern Colorado. Mr. Schmitz was formerly the president of Legatus of Colorado and an Advisory Board Member of Innovest Portfolio Solutions. Other past affiliations include serving on the boards of Machebeuf High School (past chair), PGA Foundation Board, Colorado Civil Justice League and the Accountability Committee for High Plains Elementary. Mark Bower has been in community banking for 32 years. He currently is the Executive Vice President/CFO/COO and a director of Home State Bank, a locally owned bank headquartered in Loveland Colorado with 11 branches in Northern Colorado and total assets of approximately $700 million, where he has worked the past 19 years. He oversees the bank’s operations, IT, financial planning and reporting, asset/liability management, investments, audit, and compliance areas. He is a graduate of Augustana College in South Dakota where he earned a degree in Accounting and Business Administration, completed his CPA certification in 1982, and is a graduate of the Stonier Graduate School of Banking. He is active in Loveland Sertoma and the Colorado Bankers Association. He is currently a board member of Vintage City Church and lives in Loveland with his wife Ann and their three daughters. David Kelly is the Chief Risk Officer for First - Bank Holding Company. His responsibilities include the development, implementation, and ongoing management of all enterprise risk man- agement processes for the company. He has over 22 years of experience in the financial services industry at FirstBank, with over 17 years of experi- ence in compliance and risk management. Prior to accepting his current position, he was President of Loan Operations, managed Compliance for FirstBank and gained experience at the subsidiary banks in the areas of operations management, branch management, consumer and commercial lending.
