On April 2, the FDA announced that it would start taking steps to “advance our consideration of a framework for the lawful marketing of appropriate cannabis and cannabis-derived products” – which includes a public hearing on May 31. The production of hemp and its related products now has a legal pathway, due to passage of the 2018 Farm Bill. However, while the framework may be taking shape to achieve this at both state and national levels, neither has completed their responsibilities required under the bill. The 2018 Farm Bill brought about needed reform and should usher in some clarity for lenders in banking hemp and related products. Until then, the banking of hemp and its derivatives remains a challenging and complex process that should be approached with caution.
