45 Issue 1 2017 / UCLS Foresights www.ucls.org HB0118 AUTHORITY OF STATE ENGINEER This bill clarifies the duties of the state engineer. u states that the state engineer shall make rules regarding the duty of water; and u makes technical changes HB0152 TRANSPORTATION FUNDING REVISIONS This bill modifies the Transportation Code by amending provisions relating to the Local Highway and Transportation Corridor Preservation Fund. u authorizes money in the Local Highway and Transportation Corridor Preserva - tion Fund to be used for construction, maintenance, and operation of class B and class C roads or survey monument restoration or repair with limitations in a county of the third, fourth, fifth, or sixth class; and u makes technical and conforming changes. HB0170 SMALL CLAIMS AMENDMENTS This bill modifies provisions regarding a small claims court. u addresses jurisdictional limits for small claims court; u modifies a provision regarding a motor vehicle accident; and u makes technical changes. HB0195S01 DISSOLUTION OF LOCAL DISTRICTS This bill modifies the procedure to dis - solve a local district. u reduces the threshold petitioners must reach to initiate a dissolution; u modifies provisions regarding: • procedural and public hearing require- ments for an administrative body; • required notice to the lieutenant gov - ernor regarding a dissolution; • recording a certification from the lieu - tenant governor; • payment of the costs of dissolution and the dissolved local district’s debts and liabilities; and • distribution of remaining assets of a dissolved local district; and u makes technical and conforming changes. HB0196S01 DIVISION OF REAL ESTATE AMENDMENTS This bill amends provisions related to re- porting and licensing requirements under the jurisdiction of the Division of Real Estate. u defines terms; u changes the citation period following the occurrence of a violation; u exempts a loan processor or loan un- derwriter who is not a mortgage loan originator when employed by, and acting on behalf of, a person or entity licensed under this chapter; u modifies quarterly reporting requirements; u permits the commission of powers and duties under certain circumstances; u provides licensing standards and prac- tice requirements for a branch broker, property management sales agent, and dual broker; and u makes technical changes. HB0202S01 TRESPASS AMENDMENTS This bill modifies criminal trespass provisions. u defines terms; u enacts provisions related to trespass by a long-term guest in a residence; and u provides for a penalty HB0210 FLASHING BRAKE LIGHT REVISIONS This bill revises provisions related to continuously flashing light systems for supplemental stop lamps. u revises the definition of “continuously flashing light system”; u removes the provision regarding the lock-out period after the release of the brake as relating to continuously flash - ing light systems; and u makes technical changes HB0217S03 LIVESTOCK HARASSMENT This bill prohibits the harassment of livestock. u prohibits a person from intentionally, knowingly, or recklessly chasing, actively disturbing, or harming livestock through the use of: • a motorized vehicle or all-terrain vehicle; • a dog; or • an unmanned aircraft system; and u describes the penalties for violating the prohibition on harassment of livestock. HB0232 LAND USE AMENDMENTS This bill modifies county and municipal land use provisions. u enacts and modifies definitions appli - cable to county and municipal land use provisions; u addresses a provision relating to the imposition of stricter requirements or higher standards than required by state law; u enacts a provision directing a land use authority on how to interpret and apply land use regulations and specifying the nature of a land use authority’s land use decision; u addresses provisions relating to the preparation, recommendation, and en - actment of land use regulations; u addresses a provision relating to the authority to adopt and amend land use regulations; and u addresses provisions relating to appeals of land use decisions HB0238S01 PAYMENT OF WAGES ACT AMENDMENTS This bill modifies provisions related to the payment of wages. u modifies the definition of “employer” under Title 34, Chapter 28, Payment of Wages; u requires that an employee file certain wage claims with the Labor Commis - sion; and u provides a private cause of action against an employer for certain wage claims. HB0240S02 COMMON AREA LAND USE AMENDMENTS This bill modifies provisions related to common areas and land use. u addresses ownership, conveyance, and modification of a parcel designated as a common area or a common area and facility on a recorded plat; u reduces the percentage of land- owners required to approve certain conveyances; u amends requirements for recording a certain subdivision plat; and u makes technical and conforming changes
