www.ucls.org 46 Issue 1 2017 / UCLS Foresights HB0265S03 SAFETY INSPECTION AMENDMENTS This bill modifies provisions relating to motor vehicle safety equipment and in- spection programs and increases motor vehicle registration fees. u repeals the requirement that certain vehicles obtain a safety inspection cer- tificate in order to be registered and to operate on a highway; u repeals a provision making a seat belt violation a secondary offense; u increases registration fees for certain vehicles; u creates the Motor Vehicle Safety Im- pact Restricted Account and allows expenditure of the funds by the Utah Highway Patrol to: • hire new Highway Patrol troopers; • pay overtime for Highway Patrol troopers; and • acquire equipment to improve motor vehicle safety impacts and enforce- ment; and u makes technical changes. HB0273S01 CONSTRUCTION TRADES LICENSING PENALTY PERIODS AMENDMENTS This bill amends a provision related to unlawful conduct for a person licensed in a construction trade. u prohibits the division from treating unlawful conduct by a licensee as a subsequent violation of a previous unlawful conduct violation if a certain amount of time has passed since the previous violation; and u allows the division to treat multiple of the same type of unlawful conduct vi- olation as separate violations HB0313S02 LICENSURE CHANGES This bill modifies the Utah Construc- tion Trades Licensing Act (the act). u defines terms related to certain electrical contractors, plumbing con- tractors, and prelicensure course providers under the act; u modifies the testing and work experi- ence requirements for licensure as a specialty contractor under the act; u modifies continuing education require- ments for certain contractors; and u makes technical changes HB0115S01 INCORPORATION FILING AMENDMENTS This bill relates to the process by which a town is incorporated. u amends definitions; u reorders the requirements that in- dividuals must meet to file a town incorporation petition; u requires the sponsors of a town incor- poration petition to: • file an application with the lieutenant governor; and • conduct a public hearing before col- lecting signatures for the petition; u requires that at least 50% of the vot- ing-eligible population of a proposed town be registered voters; u expands a provision to allow certain property owners to remove property from a proposed town incorporation; u creates standards and process that the lieutenant governor may reject a town incorporation petition; u modifies requirements related to the selection of a feasibility consultant; u provides repeal dates for certain pro- visions that this bill makes obsolete; and u makes technical and conforming changes SB0053 LIS PENDENS AMENDMENTS This bill addresses certain lien actions and general lis pendens requirements. u addresses lis pendens requirements. SB0081 LOCAL GOVERNMENT LICENS- ING AMENDMENTS This bill modifies provisions related to a municipality’s or a county’s authority to license a business. u amends provisions authorizing a mu- nicipality or a county to license a business; u prohibits a municipality or a county from requiring a license or charging a fee for certain home based business- es; and u makes technical and conforming changes. SB0092 WORKERS’ COMPENSATION FUND REVISIONS This bill repeals the statute creating the Workers’ Compensation Fund and makes conforming amendments. u repeals the statute creating the Work- ers’ Compensation Fund; u removes statutory references to the Workers’ Compensation Fund; u addresses the obligation to write workers’ compensation insurance and residual market mechanisms; u provides for the Workers’ Compen- sation Fund’s transition to a mutual corporation; u modifies membership on the workers’ compensation advisory council; u addresses methods to obtain workers’ compensation insurance; u amends the provision addressing penalty for failure to obtain workers’ compensation; u modifies the provision addressing ex- emptions for employees temporarily in state; u addresses continuing education re- quirements for contractor licensees; and u makes technical and conforming amendments. SB0096 UNSECURED LOAD AMENDMENTS This bill defines an unsecured load on a highway and creates new penalties for op - erating a vehicle with an unsecured load on a highway. u defines unsecured load; u creates new penalties for certain violations; u instructs the department, when pos- sible, to educate the public regarding unsecured loads; and u makes technical changes. SB0109S06 SMALL EMPLOYER RETIREMENT PROGRAM This bill enacts provisions relating to tax credits for small employers. u defines terms; and u establishes an income tax credit for certain small employers that offer employees access to a qualified re- tirement plan SB0111S03 UNMANNED AIRCRAFT AMENDMENTS This bill modifies and establishes provi- sions related to unmanned aircraft. u defines terms; u reorganizes existing code related to unmanned aircraft; u preempts local laws related to un- manned aircraft; u exempts unmanned aircraft from reg- istration with the state of Utah;
